I have a unique situation, my laywer sent I-485,EAD and AP together in July. I got the receipt for I-485 but still awaiting for the reciepts for EAD and AP. Please advise what could be done in this situation, its already been almost 5 months ?

Isn't it a violation of the law, if NO reason is given while denying the 485?
The only recent case I have seen on IV was where the member got a NOID stating that the 140 was withdrawn/revoked.
So, here, a reason WAS given.
Of course, the reason might have been incorrect, as the poster seemed to think.

Dear All:
I am currently in my 7th year on H-1B (with I-140 approved) and my H-1B Visa expired a year ago and my current I-94 valid until next 2 years (same case for my dependants).
I am switching my employer now and my family is planning to goto India and when they go for visa stamping through my new employer - do you think they will get into the trouble because my visa (with old employer) is already expired?
And FYI - myself/my fmaily already had US Visas stamped for atleast 4-5times already in the past through various employers.

Even I am in similar situation. My EB3 ROW has PD of March 2006 (RD July 2007). I am not sure when my EB3 case will get approved. I have masters degree and 6 years of work experience. I can change job and get EB2 started. But will it help? Because going to new job and going through labor might take a year or more.
Could anyone please suggest whether I should change job at this point of time or wait for my EB3 case to approve?

I have ben working with employer A on an H1B ( even labor and I-140 approved, PD-April2009) and planning to apply for H1 transfer now through employer B.
After the transfer is approved for B, if I change my mind and decide to continue to work with curent employer A, can I do that ?

You can definately get a 1 year extension based on the fact that your labor is approved and is more that 365 days before your h1, 6 year limit ended. You can also port your I-140 PD if you have a copy of the I-140. This you can do when you file for I-140 with the new company. With regards to a 3 year extension with the new company "Y", there is no clear ruling on this. But you can try for a 3 year extension, and you might get it if you are lucky ( I've read that people were able to get it).

I am on an H-1 and my wife has an H-4 visa.
We filed our I-485 in July 2007 and will be current as of July 1st 2010 as per the June 2010 visa bulletin.
We do not have an AP as we didn't renew it after the first one (from July 07) expired.
We do have valid EAD�s (which we have not used until now)
We have to travel urgently to India for some personal reasons in July 2010.
What if we get our Green Card while we are gone? Can we still enter using our valid H-1/H-4 visas/status? If not, is it mandatory to have an AP to re-enter in this case?

You will have to get your AP and enter the US using it. That would be best. Consult your lawyer too..

Our attorney said we had 2 choices to get the VISA issued.Either we go to our country and get it or we can go to Bahamas for a day and get it. Apperently, Bahamas and US has an agreement and they do it very quick.
What happens if we do not get the VISA stamp on our passports? I mean we are working and do not want to leave the country,dowe still have to get the actual VISA? Do we have a problem next year when we apply for extention if we do not get the visa stampped this year?

My company is paying all cost of GC. So they refused to file after July 2nd USCIS letter.
But the July 2nd decision was reversed later. Why did they not file then?
Besides, companies do not need to pay for 485. Makes no sense for them to pay for something that they do not have to.
On a separate note, does anyone know of any company which has discontinued GC processing because the new rule states the employer has to pay for PERM?

Here is my suggestion:
Apply for H-4 as this should be straight-forward and fly your wife the US in March. Prepare H-1 papers and get it ready to reach USCIS on April 1st.
If H-1 is acceped in lottery(assuming there is going to be one), then H-1 status starts from October 1st. For travel purpose your wife will have to get H-1 stamping (which can happen only after October 1st).

To be on safe side, I suggest you first get 3 yr. ext. and then change your job.

Answer of first question, yes you can use your old PD only if your current employer (old if you change job) does not revoke it.
second answer, you can apply in perm-eb2 with new employer as you now have more exp. (old job).
But still check with another lawyer.

Get your I140 approved. Once your I-140 approves, the priority date belongs to you forever. When you move to the next company and file for your labor again (with PERM nowadays, it doesn't take more than 3 months), you can still continue like you were with your old company.

Your new company must sponsor your H1 before the old company send the request to cancel your H1.
Once revoked, you have probably couple of weeks to pack up. So, its best you get started on the new H1 before the old H1 is revoked.

Disclaimer: I'm not an immigration attroney, so consult one for your situations as laws and filing procedures are changing constantly.
most companies do the same (stop paying for H4) after initial yrs of working with them. i think they have to pay for H1 but i dont think for H4. it is easier to file the extension for H4 visa along with H1, i think it will be like 3-4 pages. i think it is somewhere around 200 for H4 (but fees changes often. check USCIS website).
send the I-539 filled and signed application to the company (with payment/reqd documents) and ask them to file both at the same time so that H4 will be approved when H1 is approved. goodluck:)
