I entered on a H4 on my New Zealand passport and it is valid 2010. I now have a H1B ie a I-797A and a new I-94 that is also valid till 2010. I'm leaving the country for the first time to go to Australia.
Do I need to get a new visa stamp for my passport?

You can do that from any consulate. However, note that there is a possibility that the IO will need a so-called "security check" which takes 2-3 months (and sometimes, years). Also the chances of getting a security check is higher if you go to a consulate other than the consulate in your home country.

I am in a very Bad situation it seems, please help.
I am working in US on L1B visa and Wife on L2. then Wife got a Job and her employer filled her 485.
In the mean time I applied for H1 (through a consultant, to get out of the L1B company). Looks like the H1 Got Approved. Now, I think the problem is, If I switch to H1, then she will loose her job and our chance of Getting EAD will go.
I do NOT want to go for H1, but EAD Is important to me. Is there a Way I can keep my L1? (so that my wife can keep her job)

On Monday USCIS was showing that my EAD card has been ordered and today it changed to Approval notice sent....
What is the difference between these two, anyone?
I know both of them sound like music to my ears but want to know WHEN exactly should I be expecting the actual EAD...

Starting April 1st, only two Service Center are responsible for all the I-140's, Nebraska & Texas. All I-140's are filed with Nebraska Service Center. Nebraska keeps some of the petitoins and transfers the others to Texas. The ones that NSC keeps has a receipt number starting with LIN whereas the ones that are transfered to TX has the receipt number starting with SRC. So even though the petition might be filed with NSC, chances are it might be approved sonner if it goes to TXSC. Nebraska is taking 4-5 months to approve a petition whereas TX approves it in 15-25 days.

However, I feel we have up-hill battle in this current political and economical situation and we need to re-think about startergies and solving current retrogession.
I just want initiate brainstorm, I am not sure if these ideas are discussed before,
Having seen how CIR bill is killed in House, I am very doubtfull about SKILL bill getting passed in house.
getting any pro-immigration (legal/illegal) is a long processes, so can we need to focus on what we can do to reduce the retrogression within current legal framework
like
lobby senators to enforce USICS on following
- Reduce time taken for Security Checks
- Try to consider 245i cases in a different catagory than EB3
- Try recapture unused visa numbers from 2003-04-05
- issue EAD/AP for three years
- remvoe per country quota
- allow to apply for I485 if I140 is approved, ( I know this is controvesial but we can try)
These simple things could reduce retrogression if not completly resolved

I probabably know the answer of this question but would still like to confirm, just to be sure:
- First I-797B Valid from Jan 2004 to Sep 2006 <- Note: wasn't for 3 years
- First Visa valid from Jul 2004 to Sep 2006
- 1st US Entry Date from Aug 2005 till present date
(been to india in Dec 2007 for 1 month for visa stamping)
- First i-94 valid from Aug 2005 to Sep 2006

If I was in your shoes I would not file unemployment benefits because our sole purpose for filling or evening being in the USA is because we have a job or job offer. I would get an odd job and make ends meet. Filing Unemployment might come back to bit you later.

Recently I renewed my Advance Parole (AP), USCIS renewed it for 9 months only. Is it possible to check with USCIS to get a 1 year AP.

You must have applied 120 days in advance or many days in advance before old AP expiry. USCIS issues AP from the date it was approved so you tend to lose some months. I have heard some other members include a cover letter which says AP start date should be from date of expiry of old AP. Since you already got the document, I doubt you can do much about it. You may lose 2-3 months just trying send it back and requesting it to be corrected. I guess next time when you renew keep the cover letter in mind.

Well, I finally got a hold of an actual human on the main USCIS number. They confirmed only that the office is open on Fridays for appointments. That means I am hitting the road to Milwaukee.

This is wrong. If you go out of USA and come back after a gap of 1 year, then only u will get full 6 years. Other wise whatever your status is ( as L1, B1 etc ) that will count into H1 period
As far as I know B1 wont count against H1 time, though L1 will.
L2 and H4 used to count, but they were decoupled at the end of 2006, and time spent in those status dont count against your H1.

Should you get immunizations done *before* you met the Dr?
If you have immunization records, you need to present to the Doctor. If you do not have records, Doctor will administer certain vaccines or will request blood work to test for the immunity against certain diseases such as Vericella, MMR, etc.

I just noticed on USCIS website that all 4 of our family's I-485 (myself, wife, 2 children) have new LUD of 4/1/2009.
The message still says "case received and pending" on all cases.
I wonder what it means?

On an average 65k/year non-Immigrant VISAS are issued by immigration services. The Dept. of State claims that 60k immigrant VISA numbers exhausted by June 29, 07. The total number of applicants in the rat race should sum up to at least 260k as on June07.
Numbers do the math...
The June07 bulletin priority dates for India trace back to EB3-June03 & EB2-April04. At the same time about combined ~65k*4(June03-June07) = 260k were looking forward to get ahead in the rat race. Assume that 70% of 260k i.e. 182k had approved labors/substitution labor. The 182k caused to exhaust the 60k available immigrant VISAS then still about 102k are left in the air as non-immigrant alien workers.
The suck-more theory�
Since, the bulletin was issued on June 13, 07 (13 = dooms day) ~102k rushed to local stores like Sears, Walgreen, CVS for 2�� * 2 �� passport size photographs. The non-immigrant alien workers spent around 182k* ~$60 = $10.9mil for 6 passport size photographs. This explains why Walgreen (WALG) which was trailing at $43.xx on NASDAQ in May07 shot up to $45 in June07 and suddenly tumbled down to $43.xx after the revised bulletin. Certified civil surgeons to perform medical examination pocketed medical history�s best earnings in a span of 2 weeks raking revenues of about 182k* ~$275 = ~$50mil. NASDAQ touched years best @2650 in June07. Immigration lawyers charge about $1500 for I140 petition. Market rates for immigrant 485 petition is about $1400 for principal applicant and extra $750 for each dependent. Assuming that the average spending of 182k(singles, married, 2/3dependent applicants) amounted to $2000 for I140 and $2000 for I485 this totals to about 182k*$4000 = guess what!! $728mil. This means that there should be tremendous sales of Bentleys, Porsches, Lexus, Audis, BMWs this year. Projected sales of luxury cars should touch around $500mil for luxury cars alone in Q3. There are orgnizations that are opposed to this bill and are stronger than us. Only consistant efforts to make our voices heard would produce favorable results. We need letters comming from all members to these lawmakers so that when we lobby, these lawmakers already know that there are a lot of people who want this done and there is a broad support for such reforms.

But as a recent believer in buddhist ideals, I think I will just be a cow in my next life..
That brings up a good point.. as a cow, it would be a bad life for me in USA.. India would be much better bet.. I would be worshipped and rarely eaten.. hmm.. Thinking ahead of the curve, I think I will apply for a "cow green card" for India.. Cows will be clamouring to get to India.. I will be mooing away soon..

I understand I can�t invoke AC21, but I was reading somewhere that � if you are changing your sponsored company and found same or similar job, then and then you need to file AC21, in my case my sponsored company is still same and ones I got GC, I will start working for them (like future employment).

Hi,
I just saw on DOL website that my PBEC labor has been approved, on the other hand my old i-140 is stuck in NSC filed Sept 9th, 2006 EB3.
My question is how can i port my old PD? Should i wait for the old i-140 to be approved and then file for the new one or is there a way i can use the old i-140 later on during the 485 filing time to port the PD?
Any suggestion will be appreciated.
