So step children get the same benefits as dependants. Good to know. I guess if it wasnt so, someone would have raised some issue about it by now. Atleast there would have been a bill in congress.

Foreign workers have a stake in fight to change laws.
Activists on both sides of the immigration debate tend to focus on the millions of illegal immigrants whose fate rests on whether Congress passed a law.
But foreigners here legally also have a stake in this fight.
The U.S. issues temporary worker visas, called H-1B after their official classification, to thousands of non-residents each year. Often, they hold college degrees and have technical skills.
Microsoft and other technology companies hire many workers this way. They often have to prove they can't hire skilled U.S. citizens to fill those jobs first.
Bill Gates wrote in the Washington Post several years back that there is an employment gap that H-1B visas help fill:
This issue has reached a crisis point. Computer science employment is growing by nearly 100,000 jobs annually. But at the same time studies show that there is a dramatic decline in the number of students graduating with computer science degrees.
The United States provides 65,000 temporary H-1B visas each year to make up this shortfall -- not nearly enough to fill open technical positions.
H-1B workers, who have united under grassroots groups like Immigration Voice , want more than just an increase in visas. They want the government to streamline the rules.
Currently, the workers have to apply for green cards through their employers, often a lengthy and cumbersome process. They can't switch jobs easily and sometimes have to reapply for a visa even if they move jobs within the same company. They have to leave the country every few years before they can reapply for a visa.
The workers can also apply for a spouse to come to the U.S., but their partners are not allowed to work under the H-4 status granted to them. The activists argue that those individuals represent a skilled base of workers who could contribute to the U.S. economy and help pay for household expenses.
Powerful corporations back the H-1 B workers in their demands, since it would make it easier for them to hire skilled workers. But groups like Numbers USA argue that those companies shouldn't hire non-residents at a time when many Americans are jobless.

I don't know about legal risks but health-wise that sounds quite risky.
I can't believe to what extent some people will go to earn money!

If every one thinks like you, how in the world would drugs be developed to cure the diseases? :D :) Note that before any drugs gets to the stage of human subjects research, it would have completed several trials to ensure that its safe. Adverse events may happen during the trial but in recent studies, not many.
Generally, there will be an orientation and screening before enrollments, you will get all the information at that stage and you may choose not to enroll or if you have any particular condition identified during screening, you will not even be enrolled.
Risks are very minimum. Good luck.

The way USCIS knows that is you will show paycheck without valid H1.

I am planning to work on EAD soon and switch my employer using AC21. How would USCIS know that I have switched from H1b to EAD. I might change my mind after 1 months and get back to H1 transfer and work on H1 instead on EAD.
This depends on if the future project is long term and I switch to H1B just to be safe.
Any ideas would be appreciated...

Has anyone requested premium processing of I-140 based on expiry of the sixth year of H1B. My 6th year H1B expires next month and I think I am eligible for premium processing.
You are eligible only if there is *no* other way of extending your H1-B. If your labor certificate is more than 1 year old, then you are not eligible. In that case you can get 1 year extension based on the LC.

Hi there,
I changed my address using the online facility provided by USCIS by filling out the AR-11 form. I got the confirmation for that. After that when I started to change for pending petitions (I-485), lost my internet connection. I could not go back to that part again.
I checked all the FAQ's etc but could not find a link that would explain how to change only the pending petitions, since AR-11 was already changed.
Please let me know if anybody was in the similar situation.

Everyone knows they are behind in their receipting at this time. They have channeled all resources at this time to the 485 petitions.
So much so that they suspended PPS for 140s, they don't want new 485s, even EAD/AP applications are being unduely delayed. Beyond their service commitment times with no reasons.
I think they expect to get back to normal receipting by the dates given.

Hi,
I have a situation and will appreciate thoughts on that. I was working in a company on H1B and my company got closed and Moved back to India after 2-3 months.
Now I found a new employer who has a project for me but want me to join in 1-2 weeks. SO I was wondering what options do I have?
Is it possible to apply for B1 for some time and come and simultaneously apply for H1 Transfer.
Please let me know. Your help is appreciated.

B1/B2 is not intended for work (or to even to seek work) - The best way is to apply for H1 in premium, get it stamped and go back. If everything goes smooth, total turnaround time would be 4 weeks tops.

Any body has a soft LUD on approved EAD while I 485 pending.
Mine is 485 pending and my AP had (soft) LUD dated mid of Feb 2011.
